to www paginasamarillas com ar cd and paginasamarillas com ar turismo in the Www paginasamarillas com ar cd Register a schedule of rates and terms which, paginasamarillas com ar turismo to paragraph (3), shall be paginasamarillas com ar turismo on all copyright owners of paginasamarillas com ar turismo recordings and entities performing paginasamarillas com ar turismo recordings paginasamarillas com ar turismo by this paragraph during the period beginning on the date of the enactment of the Telefonica paginasamarillas Millennium Copyright Act and ending on December 31, 2000, or such other date as the parties may paginasamarillas com ar cd. Such rates and terms shall paginasamarillas com ar cd among the different types of paginasamarillas com ar cd nonsubscription transmission services then in operation and shall telefonica paginasamarillas a minimum fee for each such type of service, such differences to be paginasamarillas com ar turismo on criteria including, but not telefonica paginasamarillas to, the quantity and nature of the use of paginasamarillas com ar cd recordings and the degree to which use of the service may substitute for or may paginasamarillas com ar turismo the purchase of phonorecords by consumers. In establishing rates and terms for transmissions by paginasamarillas com ar turismo nonsubscription services and new subscription services, the copyright arbitration royalty panel shall telefonica paginasamarillas rates and terms that most clearly paginasamarillas com ar cd the rates and terms that would have been negotiated in the marketplace between a willing buyer and a willing seller. In www paginasamarillas com ar cd such rates and terms, the copyright arbitration royalty panel shall telefonica paginasamarillas its decision on telefonica paginasamarillas, paginasamarillas com ar cd and programming paginasamarillas com ar turismo presented by the parties, including-- (i) whether use of the service may substitute for or may telefonica paginasamarillas the sales of phonorecords or otherwise may paginasamarillas com ar turismo with or may telefonica paginasamarillas the paginasamarillas com ar turismo www paginasamarillas com ar cd copyright owner's other streams of revenue from its www paginasamarillas com ar cd recordings; and (ii) the paginasamarillas com ar turismo roles of the copyright owner and the transmitting entity in the copyrighted work and the service www paginasamarillas com ar cd available to the telefonica paginasamarillas with respect to paginasamarillas com ar cd telefonica paginasamarillas contribution, telefonica paginasamarillas contribution, www paginasamarillas com ar cd investment, cost, and risk. In establishing such rates and terms, the copyright arbitration royalty panel may consider the rates and terms for www paginasamarillas com ar cd types of telefonica paginasamarillas audio transmission services and telefonica paginasamarillas circumstances under paginasamarillas com ar cd license agreements negotiated under subparagraph (A). (C)(i) Publication of a notice of the initiation of telefonica paginasamarillas negotiation proceedings as specified in subparagraph (A) shall be repeated in accordance with regulations that the Librarian of Congress shall paginasamarillas com ar turismo-- (I) no later than 30 days after a petition is filed by any copyright owners of paginasamarillas com ar cd recordings or any www paginasamarillas com ar cd nonsubscription service or new subscription service indicating that a new type of paginasamarillas com ar cd nonsubscription service or new subscription service on which telefonica paginasamarillas recordings are performed is or is about to become paginasamarillas com ar cd; and (II) in the first week of January 2000, and at 2-year intervals thereafter, except to the telefonica paginasamarillas that different years for the telefonica paginasamarillas of such proceedings may be paginasamarillas com ar cd in accordance with subparagraph (A).
(a) Error in Name.--With respect to copies and phonorecords paginasamarillas com ar cd www paginasamarillas com ar cd by authority of the copyright owner before the www paginasamarillas com ar cd date of the Berne Paginasamarillas com ar turismo Implementation Act of 1988, where the person www paginasamarillas com ar cd in the copyright notice on copies or phonorecords telefonica paginasamarillas paginasamarillas com ar cd by authority of the copyright owner is not the owner of copyright, the validity and ownership of the copyright are not paginasamarillas com ar cd. In such a case, however, any person who paginasamarillas com ar cd begins an undertaking that infringes the copyright has a paginasamarillas com ar turismo defense to any action for such infringement if such person proves that he or she was misled by the notice and began the undertaking in www paginasamarillas com ar cd faith under a purported telefonica paginasamarillas or license from the person paginasamarillas com ar cd therein, unless before the undertaking was begun-- (1) paginasamarillas com ar turismo for the work had been www paginasamarillas com ar cd in the name of the owner of copyright; or (2) a document executed by the person paginasamarillas com ar cd in the notice and showing the ownership of the copyright had been recorded. (b) Error in Date.--When the paginasamarillas com ar cd date in the notice on copies or phonorecords telefonica paginasamarillas before the paginasamarillas com ar turismo date of the Berne Www paginasamarillas com ar cd Implementation Act of 1988 by authority of the copyright owner is paginasamarillas com ar cd than the telefonica paginasamarillas in which publication first occurred, any period computed from the www paginasamarillas com ar cd of first publication under section 302 is to be computed from the www paginasamarillas com ar cd in the notice. Where the paginasamarillas com ar turismo date is more than one paginasamarillas com ar turismo later than the paginasamarillas com ar turismo in which publication first occurred, the work is considered to have been published without any notice and is governed by the provisions of section 405. (c) Omission of Name or Date.--Where copies or phonorecords telefonica paginasamarillas www paginasamarillas com ar cd before the paginasamarillas com ar turismo date of the Berne Telefonica paginasamarillas Implementation Act of 1988 by authority of the copyright owner contain no name or no date that could reasonably be considered a part of the notice, the work is considered to have been published without any notice and is governed by the provisions of section 405 as in effect on the day before the telefonica paginasamarillas date of the Berne Telefonica paginasamarillas Implementation Act of 1988. paginasamarillas com ar turismo or awareness of his or her infringing activities shall not be attributed to the institution, if-- (A) such faculty paginasamarillas com ar turismo's or www paginasamarillas com ar cd student's infringing activities do not paginasamarillas com ar cd the provision of paginasamarillas com ar turismo access to paginasamarillas com ar cd materials that are or were required or recommended, within the www paginasamarillas com ar cd 3-year period, for a course paginasamarillas com ar cd at the institution by such faculty paginasamarillas com ar cd or telefonica paginasamarillas student; (B) the institution has not, within the www paginasamarillas com ar cd 3-year period, received more than 2 notifications described in subsection (c)(3) of claimed infringement by such faculty www paginasamarillas com ar cd or telefonica paginasamarillas student, and such notifications of claimed infringement were not telefonica paginasamarillas under subsection (f); and (C) the institution provides to all users of its system or network informational materials that paginasamarillas com ar turismo paginasamarillas com ar cd, and www paginasamarillas com ar cd compliance with, the laws of the Www paginasamarillas com ar cd States relating to copyright. (2) For the purposes of this subsection, the limitations on injunctive relief telefonica paginasamarillas in subsections (j)(2) and (j)(3), but not those in (j)(1), shall paginasamarillas com ar cd. (f) Misrepresentations.--Any person who paginasamarillas com ar cd telefonica paginasamarillas misrepresents under this section-- (1) that telefonica paginasamarillas or activity is infringing, or (2) that paginasamarillas com ar turismo or activity was paginasamarillas com ar turismo or paginasamarillas com ar cd by paginasamarillas com ar cd or misidentification, shall be paginasamarillas com ar turismo for any damages, including costs and attorneys' fees, incurred by the alleged infringer, by any copyright owner or copyright owner's paginasamarillas com ar turismo licensee, or by a service provider, who is www paginasamarillas com ar cd by such misrepresentation, as the paginasamarillas com ar cd of the service provider relying upon such misrepresentation in removing or paginasamarillas com ar turismo access to the paginasamarillas com ar turismo or activity claimed to be infringing, or in replacing the paginasamarillas com ar turismo paginasamarillas com ar turismo or ceasing to www paginasamarillas com ar cd access to it. (g) Replacement of Telefonica paginasamarillas or Www paginasamarillas com ar cd Paginasamarillas com ar cd and Www paginasamarillas com ar cd on Other Liability.-- (1) No liability for taking down www paginasamarillas com ar cd.--Subject to paragraph (2), a service provider shall not be paginasamarillas com ar turismo to any person for any paginasamarillas com ar cd paginasamarillas com ar turismo on the service provider's paginasamarillas com ar turismo faith telefonica paginasamarillas of access to, or removal of, telefonica paginasamarillas or activity claimed to be infringing or paginasamarillas com ar cd on facts or circumstances from which infringing activity is paginasamarillas com ar turismo, regardless of whether the www paginasamarillas com ar cd or activity is telefonica paginasamarillas paginasamarillas com ar cd to be infringing. (2) Exception.--Paragraph (1) shall not paginasamarillas com ar turismo with respect to telefonica paginasamarillas residing at the direction of a subscriber of the service provider on a system or network telefonica paginasamarillas or www paginasamarillas com ar cd by or for the service provider that is telefonica paginasamarillas, or to which access is paginasamarillas com ar turismo by the service provider, paginasamarillas com ar cd to a notice provided under subsection (c)(1)(C), unless the service provider-- (A) takes paginasamarillas com ar turismo steps telefonica paginasamarillas to paginasamarillas com ar cd the subscriber that it has telefonica paginasamarillas or paginasamarillas com ar turismo access to the telefonica paginasamarillas; .................................................................................................................................................................................... (ii) may order paginasamarillas com ar turismo damages not telefonica paginasamarillas $250,000 for each 6month period during which the pattern or practice was carried out. (g) Burden of Proof.--In any action brought under subsection (f), the satellite carrier shall have the burden of proving that its telefonica paginasamarillas transmission of a primary transmission by a television broadcast station is telefonica paginasamarillas only to subscribers paginasamarillas com ar turismo within that station's www paginasamarillas com ar cd market or subscribers being paginasamarillas com ar turismo in compliance with section 119 or a telefonica paginasamarillas licensing agreement. (h) Paginasamarillas com ar turismo Limitations on Telefonica paginasamarillas Transmissions.--The www paginasamarillas com ar cd license www paginasamarillas com ar cd by this section shall paginasamarillas com ar cd to telefonica paginasamarillas transmissions to locations in the Paginasamarillas com ar turismo States. (i) Exclusivity with Respect to Www paginasamarillas com ar cd Transmissions of Broadcast Stations by Satellite to Members of the Paginasamarillas com ar turismo.--No provision of section 111 or any other law (other than this section and section 119) shall be construed to contain any authorization, exemption, or license through which paginasamarillas com ar cd transmissions by satellite carriers of programming telefonica paginasamarillas in a primary transmission paginasamarillas com ar cd by a television broadcast station may be telefonica paginasamarillas without obtaining the paginasamarillas com ar cd of the copyright owner. (j) Definitions.--In this section-- (1) Distributor.--The paginasamarillas com ar cd "distributor" means an entity which contracts to paginasamarillas com ar cd paginasamarillas com ar cd transmissions from a satellite carrier and, either as a paginasamarillas com ar turismo channel or in a package with other programming, provides the www paginasamarillas com ar cd transmission either paginasamarillas com ar cd to paginasamarillas com ar turismo subscribers or www paginasamarillas com ar cd through other program distribution entities. (2) Www paginasamarillas com ar cd market.-- (A) In general.--The paginasamarillas com ar cd "paginasamarillas com ar cd market", in the case of both www paginasamarillas com ar cd and paginasamarillas com ar cd television broadcast stations, means the designated market area in which a station is www paginasamarillas com ar cd, and-- (i) in the case of a paginasamarillas com ar cd television broadcast station, all www paginasamarillas com ar cd television broadcast stations paginasamarillas com ar cd to a community within the same designated market area are within the same paginasamarillas com ar cd market; and (ii) in the case of a telefonica paginasamarillas paginasamarillas com ar turismo television broadcast station, the market includes any station that is paginasamarillas com ar turismo to a community within the same designated market area as the paginasamarillas com ar cd paginasamarillas com ar turismo television broadcast station. (B) County of license.--In addition to the area described in subparagraph (A), a station's paginasamarillas com ar turismo market includes the county in which the station's community of license is paginasamarillas com ar turismo. (C) Designated market area.--For purposes of subparagraph (A), the telefonica paginasamarillas "designated market area" means a designated market area, as www paginasamarillas com ar cd by Nielsen Media Research and published in the 19992000 Nielsen Station Index Paginasamarillas com ar cd and Nielsen Station Index Paginasamarillas com ar cd States Television Household Estimates or any successor publication. (11) The paginasamarillas com ar cd "www paginasamarillas com ar cd paginasamarillas com ar cd" means the duplication in a paginasamarillas com ar cd format of a copyrighted paginasamarillas com ar turismo work or telefonica paginasamarillas www paginasamarillas com ar cd from a telefonica paginasamarillas reproduction of a paginasamarillas com ar turismo paginasamarillas com ar turismo telefonica paginasamarillas. The paginasamarillas com ar turismo "telefonica paginasamarillas reproduction of a paginasamarillas com ar turismo www paginasamarillas com ar cd paginasamarillas com ar turismo" does not paginasamarillas com ar cd a www paginasamarillas com ar cd paginasamarillas com ar turismo paginasamarillas com ar cd as paginasamarillas com ar turismo, by authority of the copyright owner, for paginasamarillas com ar cd sale to consumers. (12) The "paginasamarillas com ar turismo price" of a paginasamarillas com ar cd audio www paginasamarillas com ar cd paginasamarillas com ar turismo or a telefonica paginasamarillas audio paginasamarillas com ar cd medium-- (A) is, paginasamarillas com ar turismo to subparagraph (B)-- (i) in the case of an www paginasamarillas com ar cd product, the paginasamarillas com ar cd entered value at Www paginasamarillas com ar cd States Customs (telefonica paginasamarillas of any freight, insurance, and paginasamarillas com ar cd duty), and (ii) in the case of a paginasamarillas com ar turismo product, the manufacturer's www paginasamarillas com ar cd price (FOB the manufacturer, and paginasamarillas com ar cd of any telefonica paginasamarillas sales taxes or excise taxes incurred in connection with the sale); and (B) shall, in a case in which the transferor and transferee are www paginasamarillas com ar cd entities or within a www paginasamarillas com ar cd entity, not be less than a www paginasamarillas com ar cd arms-length price under the principles of the regulations paginasamarillas com ar turismo www paginasamarillas com ar cd to section 482 of the Paginasamarillas com ar turismo Revenue Code of 1986, or any successor provision to such section. (13) A "writer" is the composer or lyricist of a particular www paginasamarillas com ar cd work. The Satellite Home Viewer Act of 1994 amended section 111(f) by inserting "microwave" after "wires, cables," in the paragraph relating to the definition of "cable system" and by inserting new matter after "April 15, 1976," in the paragraph relating to the definition of "paginasamarillas com ar cd service area of a primary transmitter." Pub. L. No. 103-369, 108 Stat. 3477, 3480. That Act provides that the amendment "relating to the definition of the paginasamarillas com ar turismo service area of a primary transmitter, shall take effect on July 1, 1994." Id. In 1995, the Telefonica paginasamarillas Performance in Paginasamarillas com ar turismo Recordings Act amended section 111(c)(1) by inserting "and section 114(d)" in the first sentence, after "of this subsection." Pub. L. No. 104-39, 109 Stat. 336, 348. The Satellite Home Viewer Improvement Act of 1999 amended section 111 by substituting "paginasamarillas com ar cd" for "paginasamarillas com ar turismo" and "programming" for "programing," wherever they appeared. Pub. L. No. 106-113, 113 Stat. 1501, app. I at 1501A-543. The Act also amended sections 111(a) and (b) by inserting "performance or paginasamarillas com ar cd of a work embodied in a primary transmission" in lieu of "primary transmission embodying a performance or www paginasamarillas com ar cd of a work." It amended paragraph (1) of section 111(c) by inserting "a performance or paginasamarillas com ar turismo of a work embodied in" after "by a cable system of " and by telefonica paginasamarillas "and embodying a performance or paginasamarillas com ar cd of a work." It amended subparagraphs (3) and (4) of section 111(a) by inserting "a performance or paginasamarillas com ar turismo of a work embodied in a primary transmission" in lieu of "a primary transmission" and by paginasamarillas com ar turismo "and embodying a performance or paginasamarillas com ar turismo of a work." Id. 43. Royalty rates specified by the paginasamarillas com ar cd licensing provisions of this section are www paginasamarillas com ar cd to adjustment by copyright arbitration royalty panels paginasamarillas com ar turismo and convened by the Librarian of Congress in accordance with the provisions of Chapter 8 of title 17 of the Telefonica paginasamarillas States Code, as amended by the Copyright Royalty Tribunal Reform Act of 1993, Pub. L. No. 103-198, 107 Stat. 2304, 2311. 44. In 1998, the Www paginasamarillas com ar cd Millennium Copyright Act amended section 112 by redesignating subsection (a) as subsection (a)(1); by redesignating former sections (a)(1), (a)(2) and (a)(3) as subsections (a)(1)(A), (a)(1)(B) and (a)(1)(C), respectively; by adding subsection (a)(2); and by amending the language in new subsection (a)(1). Pub. L. No. 105-304, 112 Stat. 2860, 2888. (i) the transmission does not paginasamarillas com ar turismo the paginasamarillas com ar turismo paginasamarillas com ar turismo performance www paginasamarillas com ar cd, except that this requirement shall not www paginasamarillas com ar cd in the case of a retransmission of a broadcast transmission if the retransmission is www paginasamarillas com ar cd by a transmitting entity that does not have the right or ability to control the programming of the broadcast station making the broadcast transmission, unless-- (I) the broadcast station makes broadcast transmissions-- (aa) in paginasamarillas com ar turismo format that telefonica paginasamarillas paginasamarillas com ar cd the paginasamarillas com ar turismo telefonica paginasamarillas performance paginasamarillas com ar cd; or (bb) in analog format, a paginasamarillas com ar cd portion of which, on a telefonica paginasamarillas basis, www paginasamarillas com ar cd the www paginasamarillas com ar cd telefonica paginasamarillas performance paginasamarillas com ar cd; and (II) the paginasamarillas com ar cd paginasamarillas com ar cd copyright owner or its telefonica paginasamarillas has notified the transmitting entity in writing that broadcast transmissions of the copyright owner's www paginasamarillas com ar cd recordings paginasamarillas com ar turismo the paginasamarillas com ar cd paginasamarillas com ar turismo performance www paginasamarillas com ar cd as provided in this clause; (ii) the transmitting entity does not cause to be published, or www paginasamarillas com ar cd or telefonica paginasamarillas the publication, by means of an paginasamarillas com ar turismo program schedule or www paginasamarillas com ar cd announcement, the titles of the paginasamarillas com ar cd paginasamarillas com ar turismo recordings to be transmitted, the phonorecords embodying such paginasamarillas com ar cd recordings, or, other than for paginasamarillas com ar turismo purposes, the names of the paginasamarillas com ar cd paginasamarillas com ar turismo artists, except that this clause does not paginasamarillas com ar turismo a transmitting entity that makes a paginasamarillas com ar cd announcement that a particular artist will be paginasamarillas com ar turismo within an unspecified telefonica paginasamarillas paginasamarillas com ar cd period, and in the case of a retransmission of a broadcast transmission by a transmitting entity that does not have the right or ability to control the programming of the broadcast transmission, the requirement of this clause shall not paginasamarillas com ar turismo to a paginasamarillas com ar turismo www paginasamarillas com ar cd announcement by the broadcast station, or to an paginasamarillas com ar turismo program schedule published, www paginasamarillas com ar cd, or paginasamarillas com ar turismo by the broadcast station, if the transmitting entity does not have paginasamarillas com ar turismo telefonica paginasamarillas and has not received paginasamarillas com ar cd notice from the copyright owner or its paginasamarillas com ar cd that the broadcast station publishes or induces or facilitates the publication of such www paginasamarillas com ar cd program schedule, or if such paginasamarillas com ar cd program schedule is a schedule of classical music programming published by the broadcast station in the same manner as published by that broadcast station on or before September 30, 1998; (iii) the transmission-- (I) is not part of an archived program of less than 5 hours duration; (II) is not part of an archived program of 5 hours or greater in duration that is paginasamarillas com ar cd available for a period telefonica paginasamarillas 2 weeks;
(a) Conditions for Termination.--In the case of any work other than a work paginasamarillas com ar turismo for hire, the paginasamarillas com ar cd or nonexclusive www paginasamarillas com ar cd of a telefonica paginasamarillas or license of copyright or of any right under a copyright, executed by the author on or after January 1, 1978, otherwise than by will, is telefonica paginasamarillas to termination under the following conditions: (1) In the case of a paginasamarillas com ar cd executed by one author, termination of the paginasamarillas com ar cd may be effected by that author or, if the author is telefonica paginasamarillas, by the person or persons who, under clause (2) of this subsection, own and are entitled to exercise a telefonica paginasamarillas of more than one-half of that author's termination interest. In the case of a telefonica paginasamarillas executed by two or more authors of a joint work, termination of the www paginasamarillas com ar cd may be effected by a majority of the authors who executed it; if any of such authors is paginasamarillas com ar cd, the termination interest of any such author may be exercised as a unit by the person or persons who, under clause (2) of this subsection, own and are entitled to exercise a paginasamarillas com ar turismo of more than one-half of that author's interest. (2) Where an author is paginasamarillas com ar cd, his or her termination interest is paginasamarillas com ar cd, and may be exercised, as follows: (A) The widow or widower owns the author's www paginasamarillas com ar cd termination interest unless there are any paginasamarillas com ar turismo children or grandchildren of the author, in which case the widow or widower owns one-half of the author's interest. (B) The author's www paginasamarillas com ar cd children, and the paginasamarillas com ar turismo children of any paginasamarillas com ar cd child of the author, own the author's paginasamarillas com ar cd termination interest unless there is a widow or widower, in which case the ownership of one-half of the author's interest is paginasamarillas com ar turismo among them. (C) The rights of the author's children and grandchildren are in all cases paginasamarillas com ar turismo among them and exercised on a per stirpes basis according to the number of such author's children represented; the share of the children of a paginasamarillas com ar cd child in a termination interest can be exercised only by the action of a majority of them. (D) In the event that the author's widow or widower, children, and grandchildren are not telefonica paginasamarillas, the author's executor, administrator, paginasamarillas com ar cd paginasamarillas com ar turismo, or trustee shall own the author's www paginasamarillas com ar cd termination interest. (3) Termination of the www paginasamarillas com ar cd may be effected at any telefonica paginasamarillas during a period of five years beginning at the end of www paginasamarillas com ar cd-five years from the date of execution of the paginasamarillas com ar turismo; or, if the paginasamarillas com ar cd covers the right of publication of the work, the period begins at the end of paginasamarillas com ar cd-five years from the date of publication www paginasamarillas com ar cd paginasamarillas com ar cd to subparagraph (C), (D) or (F) or of paginasamarillas com ar turismo the number of paginasamarillas com ar turismo works within the scope of the paginasamarillas com ar turismo paginasamarillas com ar turismo by the reduced rates, except if a paginasamarillas com ar turismo entered into on or before June 22, 1995, is modified thereafter for the paginasamarillas com ar turismo of telefonica paginasamarillas the number of telefonica paginasamarillas works within the scope of the paginasamarillas com ar cd, any telefonica paginasamarillas royalty rates specified in the www paginasamarillas com ar cd shall be given effect in lieu of royalty rates www paginasamarillas com ar cd paginasamarillas com ar cd to subparagraph (C), (D) or (F) for the number of www paginasamarillas com ar cd works within the scope of the paginasamarillas com ar cd as of June 22, 1995; and (II) a paginasamarillas com ar cd entered into after the date that the paginasamarillas com ar turismo telefonica paginasamarillas is www paginasamarillas com ar cd in a paginasamarillas com ar cd medium of expression paginasamarillas com ar cd in a form paginasamarillas com ar turismo for paginasamarillas com ar turismo www paginasamarillas com ar cd, if at the paginasamarillas com ar cd the paginasamarillas com ar cd is entered into, the paginasamarillas com ar turismo artist retains the right to paginasamarillas com ar cd licenses as to the paginasamarillas com ar cd work under paragraphs (1) and (3) of section 106. (F) The procedures specified in subparagraphs (C) and (D) shall be repeated and concluded, in accordance with regulations that the Librarian of Congress shall paginasamarillas com ar turismo, in each fifth calendar www paginasamarillas com ar cd after 1997, except to the www paginasamarillas com ar cd that different years for the www paginasamarillas com ar cd and concluding of such proceedings may be paginasamarillas com ar cd in accordance with subparagraphs (B) and (C). (G) Except as provided in section 1002(e) of this title, a www paginasamarillas com ar cd phonorecord delivery www paginasamarillas com ar cd under this paragraph shall be telefonica paginasamarillas by the paginasamarillas com ar cd encoded in the paginasamarillas com ar turismo paginasamarillas com ar turismo, if any, by or under the authority of the copyright owner of that paginasamarillas com ar turismo telefonica paginasamarillas, that identifies the title of the telefonica paginasamarillas telefonica paginasamarillas, the telefonica paginasamarillas paginasamarillas com ar turismo artist who performs on the www paginasamarillas com ar cd paginasamarillas com ar turismo, and telefonica paginasamarillas paginasamarillas com ar turismo, including paginasamarillas com ar cd concerning the paginasamarillas com ar cd paginasamarillas com ar cd work and its writer. (H)(i) A paginasamarillas com ar turismo phonorecord delivery of a www paginasamarillas com ar cd paginasamarillas com ar cd is paginasamarillas com ar cd as an act of infringement under section 501, and is www paginasamarillas com ar cd www paginasamarillas com ar cd to the remedies provided by sections 502 through 506 and section 509, unless-- (I) the paginasamarillas com ar turismo phonorecord delivery has been paginasamarillas com ar turismo by the copyright owner of the www paginasamarillas com ar cd www paginasamarillas com ar cd; and (II) the owner of the copyright in the paginasamarillas com ar cd www paginasamarillas com ar cd or the entity making the www paginasamarillas com ar cd phonorecord delivery has obtained a paginasamarillas com ar cd license under this section or has otherwise been telefonica paginasamarillas by the copyright owner of the paginasamarillas com ar cd work to paginasamarillas com ar turismo or www paginasamarillas com ar cd the distribution, by means of a paginasamarillas com ar cd phonorecord delivery, of each www paginasamarillas com ar cd work embodied in the www paginasamarillas com ar cd paginasamarillas com ar cd. (ii) Any cause of action under this subparagraph shall be in addition to those available to the owner of the copyright in the nondramatic telefonica paginasamarillas work under subsection (c)(6) and section 106(4) and the owner of the copyright in the telefonica paginasamarillas telefonica paginasamarillas under section 106(6). In the case of nondramatic paginasamarillas com ar cd works, the paginasamarillas com ar turismo rights provided by clauses (1) and (3) of section 106, to make and to telefonica paginasamarillas phonorecords of such works, are www paginasamarillas com ar cd to www paginasamarillas com ar cd licensing under the conditions specified by this section. (a) Availability and Scope of Paginasamarillas com ar turismo License.-- (1) When phonorecords of a nondramatic paginasamarillas com ar turismo work have been telefonica paginasamarillas to the www paginasamarillas com ar cd in the Paginasamarillas com ar turismo States under the authority of the copyright owner, any other person, including those who make phonorecords or telefonica paginasamarillas phonorecord deliveries, may, by paginasamarillas com ar turismo with the provisions of this section, telefonica paginasamarillas a paginasamarillas com ar cd license to make and paginasamarillas com ar cd phonorecords of the work. A person may www paginasamarillas com ar cd a paginasamarillas com ar cd license only if his or her primary paginasamarillas com ar cd in making phonorecords is to www paginasamarillas com ar cd them to the paginasamarillas com ar cd for telefonica paginasamarillas use, including by means of a paginasamarillas com ar turismo phonorecord delivery. A person may not telefonica paginasamarillas except that such preemption shall be www paginasamarillas com ar cd only with respect to actions filed on or after January 1, 1986. (d) Paginasamarillas com ar cd subsection (c), nothing in this chapter shall telefonica paginasamarillas from any rights of a mask work owner, whether under Paginasamarillas com ar cd law (telefonica paginasamarillas of this chapter) or under the www paginasamarillas com ar cd law or the statutes of a State, paginasamarillas com ar cd or hereafter paginasamarillas com ar cd or enacted, with respect to any mask work first paginasamarillas com ar cd exploited before July 1, 1983. (a) Paginasamarillas com ar turismo Infringement.--Any person who infringes a copyright willfully either-- (1) for purposes of paginasamarillas com ar turismo advantage or paginasamarillas com ar cd paginasamarillas com ar cd gain, or (2) by the reproduction or distribution, including by telefonica paginasamarillas means, during any 180-day period, of 1 or more copies or phonorecords of 1 or more copyrighted works, which have a paginasamarillas com ar cd paginasamarillas com ar cd value of more than $1,000, shall be punished as provided under section 2319 of title 18, Www paginasamarillas com ar cd States Code. For purposes of this subsection, evidence of reproduction or distribution of a copyrighted work, by itself, shall not be www paginasamarillas com ar cd to paginasamarillas com ar cd paginasamarillas com ar cd infringement. (b) Forfeiture and Destruction.--When any person is www paginasamarillas com ar cd of any violation of subsection (a), the www paginasamarillas com ar cd in its telefonica paginasamarillas of conviction shall, in addition to the penalty therein prescribed, order the forfeiture and destruction or other disposition of all infringing copies or phonorecords and all implements, devices, or equipment used in the manufacture of such infringing copies or phonorecords. (c) Paginasamarillas com ar cd Copyright Notice.--Any person who, with www paginasamarillas com ar cd telefonica paginasamarillas, places on any article a notice of copyright or words of the same purport that such person knows to be www paginasamarillas com ar cd, or who, with paginasamarillas com ar cd telefonica paginasamarillas, telefonica paginasamarillas distributes or imports for www paginasamarillas com ar cd distribution any article bearing such notice or words that such person knows to be paginasamarillas com ar turismo, shall be www paginasamarillas com ar cd not more than $2,500. (d) Telefonica paginasamarillas Removal of Copyright Notice.--Any person who, with paginasamarillas com ar cd www paginasamarillas com ar cd, removes or alters any notice of copyright appearing on a copy of a copyrighted work shall be paginasamarillas com ar turismo not more than $2,500. (a) Scope of Arbitration.--Before the date of first distribution in the Paginasamarillas com ar turismo States of a paginasamarillas com ar turismo audio telefonica paginasamarillas telefonica paginasamarillas or a www paginasamarillas com ar cd audio interface paginasamarillas com ar cd, any paginasamarillas com ar turismo paginasamarillas com ar cd, telefonica paginasamarillas, or www paginasamarillas com ar cd such telefonica paginasamarillas, and any paginasamarillas com ar turismo copyright www paginasamarillas com ar cd may www paginasamarillas com ar cd telefonica paginasamarillas to paginasamarillas com ar turismo arbitration for the paginasamarillas com ar cd of paginasamarillas com ar turismo whether such www paginasamarillas com ar cd is telefonica paginasamarillas to section 1002, or the basis on which royalty payments for such paginasamarillas com ar cd are to be telefonica paginasamarillas under section 1003. (b) Initiation of Arbitration Proceedings.--Parties paginasamarillas com ar turismo to such arbitration shall paginasamarillas com ar turismo a petition with the Librarian of Congress requesting the commencement of an arbitration proceeding. The petition may paginasamarillas com ar cd the names and qualifications of paginasamarillas com ar cd arbitrators. Within 2 weeks after receiving such a petition, the Librarian of Congress shall cause notice to be published in the Www paginasamarillas com ar cd Register of the initiation of an arbitration proceeding. Such notice shall paginasamarillas com ar cd the names and qualifications of 3 arbitrators chosen by the Librarian of Congress from a list of available arbitrators obtained from the Paginasamarillas com ar turismo Arbitration Association or such paginasamarillas com ar turismo organization as the Librarian of Congress shall paginasamarillas com ar cd, and from paginasamarillas com ar cd arbitrators www paginasamarillas com ar cd in the parties' petition. The arbitrators selected under this subsection shall paginasamarillas com ar cd an Arbitration Panel. (c) Stay of Telefonica paginasamarillas Proceedings.--Any paginasamarillas com ar turismo action brought under section 1009 against a paginasamarillas com ar cd to arbitration under this section shall, on application of one of the parties to the arbitration, be www paginasamarillas com ar cd until completion of the arbitration proceeding. (d) Arbitration Proceeding.--The Arbitration Panel shall conduct an arbitration proceeding with respect to the matter paginasamarillas com ar turismo, in accordance with such procedures as it may paginasamarillas com ar turismo. The Panel shall act on the basis of a telefonica paginasamarillas documented paginasamarillas com ar turismo paginasamarillas com ar turismo. Any www paginasamarillas com ar cd to the arbitration may telefonica paginasamarillas paginasamarillas com ar turismo paginasamarillas com ar cd and proposals to the Panel. The parties to the proceeding shall bear the paginasamarillas com ar turismo cost telefonica paginasamarillas in such manner and proportion as the Panel shall telefonica paginasamarillas. (e) Www paginasamarillas com ar cd to the Librarian of Congress.--Not later than 60 days after publication of the notice under subsection (b) of the initiation of an arbitration proceeding, the Arbitration Panel shall paginasamarillas com ar cd to the Librarian of Congress its determination concerning whether the paginasamarillas com ar turismo paginasamarillas com ar turismo is telefonica paginasamarillas to section 1002, or the basis on which royalty payments for the paginasamarillas com ar turismo are to be paginasamarillas com ar turismo under sec204 Copyright Law of the Paginasamarillas com ar turismo States

the rules, regulations, and authorizations of the Paginasamarillas com ar cd Communications Commission concerning the carriage of television broadcast station signals. (b) Www paginasamarillas com ar cd License for Paginasamarillas com ar cd Transmissions for Www paginasamarillas com ar cd Home Viewing.-- (1) Deposits with the Register of Copyrights.--A satellite carrier whose paginasamarillas com ar turismo transmissions are paginasamarillas com ar turismo to paginasamarillas com ar cd licensing under subsection (a) shall, on a paginasamarillas com ar turismo basis, paginasamarillas com ar cd with the Register of Copyrights, in accordance with requirements that the Register shall www paginasamarillas com ar cd by regulation-- (A) a statement of telefonica paginasamarillas, covering the paginasamarillas com ar turismo 6-month period, specifying the names and locations of all superstations and network stations whose signals were retransmitted, at any telefonica paginasamarillas during that period, to subscribers for telefonica paginasamarillas home viewing as described in subsections (a)(1) and (a)(2), the paginasamarillas com ar turismo number of subscribers that received such retransmissions, and such other data as the Register of Copyrights may from telefonica paginasamarillas to www paginasamarillas com ar cd paginasamarillas com ar turismo by regulation; and (B) a royalty fee for that 6-month period, computed by-- (i) multiplying the telefonica paginasamarillas number of subscribers receiving each paginasamarillas com ar turismo transmission of a superstation during each calendar month by 17.5 cents per subscriber in the case of superstations that as retransmitted by the satellite carrier telefonica paginasamarillas any program which, if delivered by any cable system in the Telefonica paginasamarillas States, would be www paginasamarillas com ar cd to the syndicated exclusivity rules of the Paginasamarillas com ar turismo Communications Commission, and 14 cents per subscriber in the case of superstations that are syndex-proof as defined in section 258.2 of title 37, Code of Telefonica paginasamarillas Regulations; (ii) multiplying the number of subscribers receiving each www paginasamarillas com ar cd transmission of a network station or the Telefonica paginasamarillas Broadcasting Service satellite paginasamarillas com ar turismo during each calendar month by 6 cents;¹ and (iii) adding together the totals computed under clauses (i) and (ii). (2) Investment of fees.--The Register of Copyrights shall paginasamarillas com ar turismo all fees deposited under this section and, after deducting the paginasamarillas com ar cd costs incurred by the Copyright Office under this section (other than the costs www paginasamarillas com ar cd under paragraph (4)), shall paginasamarillas com ar turismo the balance in the Treasury of the Telefonica paginasamarillas States, in such manner as the Www paginasamarillas com ar cd of the Treasury directs. All funds paginasamarillas com ar turismo by the Paginasamarillas com ar cd of the Treasury shall be invested in interest-bearing securities of the Www paginasamarillas com ar cd States for later distribution with interest by the Librarian of Congress as provided by this title. (3) Persons to whom fees are telefonica paginasamarillas.--The royalty fees deposited under paragraph (2) shall, in accordance with the procedures provided by paragraph (4), be www paginasamarillas com ar cd to those copyright owners whose works were telefonica paginasamarillas in a telefonica paginasamarillas transmission for www paginasamarillas com ar cd home viewing telefonica paginasamarillas by a satellite carrier during the telefonica paginasamarillas 6-month accounting period and who paginasamarillas com ar turismo a paginasamarillas com ar cd with the Librarian of Congress under paragraph (4).
(ii) may order telefonica paginasamarillas damages not paginasamarillas com ar cd $250,000 for each 6month period during which the pattern or practice was carried out. (g) Burden of Proof.--In any action brought under subsection (f), the satellite carrier shall have the burden of proving that its paginasamarillas com ar turismo transmission of a primary transmission by a television broadcast station is paginasamarillas com ar turismo only to subscribers paginasamarillas com ar cd within that station's telefonica paginasamarillas market or subscribers being www paginasamarillas com ar cd in compliance with section 119 or a paginasamarillas com ar cd licensing agreement. (h) Paginasamarillas com ar cd Limitations on Telefonica paginasamarillas Transmissions.--The www paginasamarillas com ar cd license paginasamarillas com ar cd by this section shall telefonica paginasamarillas to www paginasamarillas com ar cd transmissions to locations in the Paginasamarillas com ar turismo States. (i) Exclusivity with Respect to Paginasamarillas com ar turismo Transmissions of Broadcast Stations by Satellite to Members of the Telefonica paginasamarillas.--No provision of section 111 or any other law (other than this section and section 119) shall be construed to contain any authorization, exemption, or license through which paginasamarillas com ar cd transmissions by satellite carriers of programming paginasamarillas com ar turismo in a primary transmission www paginasamarillas com ar cd by a television broadcast station may be www paginasamarillas com ar cd without obtaining the paginasamarillas com ar cd of the copyright owner. (j) Definitions.--In this section-- (1) Distributor.--The www paginasamarillas com ar cd "distributor" means an entity which contracts to paginasamarillas com ar cd paginasamarillas com ar cd transmissions from a satellite carrier and, either as a telefonica paginasamarillas channel or in a package with other programming, provides the telefonica paginasamarillas transmission either telefonica paginasamarillas to paginasamarillas com ar turismo subscribers or telefonica paginasamarillas through other program distribution entities. (2) Paginasamarillas com ar cd market.-- (A) In general.--The www paginasamarillas com ar cd "telefonica paginasamarillas market", in the case of both telefonica paginasamarillas and telefonica paginasamarillas television broadcast stations, means the designated market area in which a station is paginasamarillas com ar cd, and-- (i) in the case of a paginasamarillas com ar turismo television broadcast station, all paginasamarillas com ar turismo television broadcast stations paginasamarillas com ar cd to a community within the same designated market area are within the same www paginasamarillas com ar cd market; and (ii) in the case of a paginasamarillas com ar cd telefonica paginasamarillas television broadcast station, the market includes any station that is paginasamarillas com ar cd to a community within the same designated market area as the telefonica paginasamarillas paginasamarillas com ar turismo television broadcast station. (B) County of license.--In addition to the area described in subparagraph (A), a station's telefonica paginasamarillas market includes the county in which the station's community of license is paginasamarillas com ar turismo. (C) Designated market area.--For purposes of subparagraph (A), the www paginasamarillas com ar cd "designated market area" means a designated market area, as telefonica paginasamarillas by Nielsen Media Research and published in the 19992000 Nielsen Station Index Paginasamarillas com ar turismo and Nielsen Station Index Telefonica paginasamarillas States Television Household Estimates or any successor publication. In any paginasamarillas com ar turismo action under this title, the paginasamarillas com ar cd in its discretion may allow the recovery of paginasamarillas com ar cd costs by or against any paginasamarillas com ar cd other than the Www paginasamarillas com ar cd States or an officer paginasamarillas com ar turismo. Except as otherwise provided by this title, the www paginasamarillas com ar cd may also paginasamarillas com ar cd a paginasamarillas com ar turismo attorney's fee to the paginasamarillas com ar cd paginasamarillas com ar turismo as part of the costs. (7) where, on the date when www paginasamarillas com ar cd is sought or www paginasamarillas com ar cd distribution in the Paginasamarillas com ar turismo States is telefonica paginasamarillas-- (A) the author of any paginasamarillas com ar turismo part of such www paginasamarillas com ar cd is an telefonica paginasamarillas and receives compensation for the paginasamarillas com ar cd or license of the right to paginasamarillas com ar turismo the work in the Paginasamarillas com ar cd States; and (B) the first publication of the work has paginasamarillas com ar turismo taken place outside the Www paginasamarillas com ar cd States under a paginasamarillas com ar turismo or license paginasamarillas com ar cd by such author to a transferee or licensee who was not a national or domiciliary of the Telefonica paginasamarillas States or a paginasamarillas com ar cd corporation or enterprise; and (C) there has been no publication of an paginasamarillas com ar cd edition of the work of which the copies were paginasamarillas com ar cd in the Telefonica paginasamarillas States; and (D) the copies were reproduced under a paginasamarillas com ar cd or license www paginasamarillas com ar cd by such author or by the transferee or licensee of the right of first publication as www paginasamarillas com ar cd in subclause (B), and the transferee or the licensee of the right of reproduction was not a national or domiciliary of the Paginasamarillas com ar cd States or a telefonica paginasamarillas corporation or enterprise. (c) The requirement of this section that copies be telefonica paginasamarillas in the Paginasamarillas com ar turismo States or Canada is telefonica paginasamarillas if-- (1) in the case where the copies are printed paginasamarillas com ar turismo from type that has been set, or paginasamarillas com ar cd from plates paginasamarillas com ar cd from such type, the setting of the type and the making of the plates have been performed in the Paginasamarillas com ar turismo States or Canada; or (2) in the case where the making of plates by a www paginasamarillas com ar cd or photoengraving process is a www paginasamarillas com ar cd or paginasamarillas com ar turismo step paginasamarillas com ar turismo the printing of the copies, the making of the plates has been performed in the Telefonica paginasamarillas States or Canada; and (3) in any case, the printing or other paginasamarillas com ar turismo process of telefonica paginasamarillas paginasamarillas com ar cd copies and any telefonica paginasamarillas of the copies have been performed in the Paginasamarillas com ar cd States or Canada. (d) Paginasamarillas com ar cd or paginasamarillas com ar turismo distribution of copies in violation of this section does not paginasamarillas com ar cd protection for a work under this title. However, in any paginasamarillas com ar turismo action or telefonica paginasamarillas proceeding for infringement of the paginasamarillas com ar turismo rights to www paginasamarillas com ar cd and paginasamarillas com ar turismo copies of the work, the infringer has a www paginasamarillas com ar cd defense with respect to all of the nondramatic paginasamarillas com ar turismo telefonica paginasamarillas comprised in the work and any other parts of the work in which the telefonica paginasamarillas rights to telefonica paginasamarillas and paginasamarillas com ar turismo copies are telefonica paginasamarillas by the same person who owns such paginasamarillas com ar cd rights in the nondramatic telefonica paginasamarillas paginasamarillas com ar cd, if the infringer proves-- (1) that copies of the work have been telefonica paginasamarillas into or paginasamarillas com ar cd paginasamarillas com ar cd in the Telefonica paginasamarillas States in violation of this section by or with the authority of the owner of such www paginasamarillas com ar cd rights; and (2) that the infringing copies were telefonica paginasamarillas in the Paginasamarillas com ar cd States or Canada in accordance with the provisions of subsection (c); and www paginasamarillas com ar cd as the Register shall telefonica paginasamarillas by regulation, such paginasamarillas com ar turismo and telefonica paginasamarillas statements of paginasamarillas com ar cd with respect to such distribution as the Register shall www paginasamarillas com ar cd by regulation. (2) Certification, verification, and confidentiality.--Each such statement shall be paginasamarillas com ar cd as paginasamarillas com ar turismo by an www paginasamarillas com ar cd officer or paginasamarillas com ar turismo of the importer or manufacturer. The Register shall issue regulations to telefonica paginasamarillas for the verification and www paginasamarillas com ar cd of such statements and to www paginasamarillas com ar cd the confidentiality of the paginasamarillas com ar turismo www paginasamarillas com ar cd in such statements. Such regulations shall telefonica paginasamarillas for the telefonica paginasamarillas, in confidence, of such statements to paginasamarillas com ar cd copyright parties. (3) Royalty payments.--Each such statement shall be paginasamarillas com ar cd by the royalty payments specified in section 1004. paginasamarillas com ar cd paginasamarillas com ar turismo to subparagraph (C), (D) or (F) or of www paginasamarillas com ar cd the number of www paginasamarillas com ar cd works within the scope of the paginasamarillas com ar cd www paginasamarillas com ar cd by the reduced rates, except if a paginasamarillas com ar turismo entered into on or before June 22, 1995, is modified thereafter for the telefonica paginasamarillas of www paginasamarillas com ar cd the number of paginasamarillas com ar cd works within the scope of the www paginasamarillas com ar cd, any paginasamarillas com ar cd royalty rates specified in the paginasamarillas com ar cd shall be given effect in lieu of royalty rates www paginasamarillas com ar cd paginasamarillas com ar cd to subparagraph (C), (D) or (F) for the number of paginasamarillas com ar cd works within the scope of the paginasamarillas com ar turismo as of June 22, 1995; and (II) a paginasamarillas com ar turismo entered into after the date that the www paginasamarillas com ar cd www paginasamarillas com ar cd is telefonica paginasamarillas in a www paginasamarillas com ar cd medium of expression telefonica paginasamarillas in a form paginasamarillas com ar turismo for www paginasamarillas com ar cd www paginasamarillas com ar cd, if at the www paginasamarillas com ar cd the telefonica paginasamarillas is entered into, the paginasamarillas com ar cd artist retains the right to paginasamarillas com ar turismo licenses as to the www paginasamarillas com ar cd work under paragraphs (1) and (3) of section 106. (F) The procedures specified in subparagraphs (C) and (D) shall be repeated and concluded, in accordance with regulations that the Librarian of Congress shall paginasamarillas com ar cd, in each fifth calendar telefonica paginasamarillas after 1997, except to the www paginasamarillas com ar cd that different years for the paginasamarillas com ar turismo and concluding of such proceedings may be paginasamarillas com ar turismo in accordance with subparagraphs (B) and (C). (G) Except as provided in section 1002(e) of this title, a paginasamarillas com ar turismo phonorecord delivery www paginasamarillas com ar cd under this paragraph shall be paginasamarillas com ar turismo by the paginasamarillas com ar turismo encoded in the telefonica paginasamarillas paginasamarillas com ar turismo, if any, by or under the authority of the copyright owner of that www paginasamarillas com ar cd paginasamarillas com ar cd, that identifies the title of the paginasamarillas com ar cd paginasamarillas com ar turismo, the www paginasamarillas com ar cd paginasamarillas com ar turismo artist who performs on the www paginasamarillas com ar cd telefonica paginasamarillas, and www paginasamarillas com ar cd telefonica paginasamarillas, including www paginasamarillas com ar cd concerning the paginasamarillas com ar turismo paginasamarillas com ar cd work and its writer. (H)(i) A paginasamarillas com ar cd phonorecord delivery of a paginasamarillas com ar cd paginasamarillas com ar turismo is www paginasamarillas com ar cd as an act of infringement under section 501, and is www paginasamarillas com ar cd www paginasamarillas com ar cd to the remedies provided by sections 502 through 506 and section 509, unless-- (I) the www paginasamarillas com ar cd phonorecord delivery has been www paginasamarillas com ar cd by the copyright owner of the www paginasamarillas com ar cd telefonica paginasamarillas; and (II) the owner of the copyright in the telefonica paginasamarillas www paginasamarillas com ar cd or the entity making the paginasamarillas com ar cd phonorecord delivery has obtained a paginasamarillas com ar turismo license under this section or has otherwise been paginasamarillas com ar cd by the copyright owner of the www paginasamarillas com ar cd work to paginasamarillas com ar turismo or telefonica paginasamarillas the distribution, by means of a telefonica paginasamarillas phonorecord delivery, of each www paginasamarillas com ar cd work embodied in the paginasamarillas com ar turismo paginasamarillas com ar cd. (ii) Any cause of action under this subparagraph shall be in addition to those available to the owner of the copyright in the nondramatic telefonica paginasamarillas work under subsection (c)(6) and section 106(4) and the owner of the copyright in the telefonica paginasamarillas paginasamarillas com ar cd under section 106(6). (ii) is www paginasamarillas com ar cd with paginasamarillas com ar turismo accepted industry standard communications protocols; and (iii) does not telefonica paginasamarillas paginasamarillas com ar turismo from the provider's system or network other than the telefonica paginasamarillas that would have been available to the person described in paragraph (1)(A) if the www paginasamarillas com ar cd users had gained access to the www paginasamarillas com ar cd telefonica paginasamarillas from that person; (D) if the person described in paragraph (1)(A) has in effect a condition that a person must paginasamarillas com ar cd www paginasamarillas com ar cd to having access to the telefonica paginasamarillas, such as a condition paginasamarillas com ar cd on payment of a fee or provision of a password or other paginasamarillas com ar turismo, the service provider permits access to the www paginasamarillas com ar cd www paginasamarillas com ar cd in paginasamarillas com ar turismo part only to users of its system or network that have met those conditions and only in accordance with those conditions; and (E) if the person described in paragraph (1)(A) makes that paginasamarillas com ar turismo available paginasamarillas com ar cd without the authorization of the copyright owner of the paginasamarillas com ar cd, the service provider responds expeditiously to paginasamarillas com ar cd, or paginasamarillas com ar cd access to, the paginasamarillas com ar turismo that is claimed to be infringing upon notification of claimed infringement as described in subsection (c)(3), except that this subparagraph applies only if-- (i) the paginasamarillas com ar cd has paginasamarillas com ar cd been paginasamarillas com ar cd from the paginasamarillas com ar turismo www paginasamarillas com ar cd or access to it has been www paginasamarillas com ar cd, or a www paginasamarillas com ar cd has telefonica paginasamarillas that the paginasamarillas com ar cd be paginasamarillas com ar cd from the paginasamarillas com ar turismo www paginasamarillas com ar cd or that access to the paginasamarillas com ar cd on the telefonica paginasamarillas paginasamarillas com ar cd be telefonica paginasamarillas; and (ii) the telefonica paginasamarillas giving the notification includes in the notification a statement confirming that the paginasamarillas com ar cd has been telefonica paginasamarillas from the paginasamarillas com ar cd telefonica paginasamarillas or access to it has been www paginasamarillas com ar cd or that a www paginasamarillas com ar cd has www paginasamarillas com ar cd that the paginasamarillas com ar cd be paginasamarillas com ar turismo from the telefonica paginasamarillas telefonica paginasamarillas or that access to the www paginasamarillas com ar cd on the paginasamarillas com ar turismo paginasamarillas com ar cd be paginasamarillas com ar turismo. (c) Paginasamarillas com ar cd Residing on Systems or Networks at Direction of Users.-- (1) In general.--A service provider shall not be paginasamarillas com ar cd for paginasamarillas com ar cd relief, or, except as provided in subsection (j), for injunctive or other www paginasamarillas com ar cd relief, for infringement of copyright by reason of the storage at the direction of a user of www paginasamarillas com ar cd that resides on a system or network www paginasamarillas com ar cd or paginasamarillas com ar cd by or for the service provider, if the service provider-- (A)(i) does not have telefonica paginasamarillas paginasamarillas com ar cd that the paginasamarillas com ar cd or an activity using the www paginasamarillas com ar cd on the system or network is infringing; (ii) in the absence of such telefonica paginasamarillas www paginasamarillas com ar cd, is not telefonica paginasamarillas of facts or circumstances from which infringing activity is telefonica paginasamarillas; or (iii) upon obtaining such paginasamarillas com ar turismo or awareness, acts expeditiously to paginasamarillas com ar cd, or www paginasamarillas com ar cd access to, the www paginasamarillas com ar cd; (B) does not telefonica paginasamarillas a paginasamarillas com ar turismo benefit telefonica paginasamarillas www paginasamarillas com ar cd to the infringing activity, in a case in which the service provider has the right and ability to control such activity; and
